Terms of Service
These terms explain what ProTruckSolutions is, what we are not, and what both sides agree to when you use our dispatch service.
Last updated: October 30, 2026
These terms govern your use of protrucksolutions.com and any dispatch services you get from ProTruckSolutions ("we," "us," or "our"). By using this site or our services, you agree to these terms.
What we are
ProTruckSolutions is a truck dispatch service. We are not a motor carrier, we do not own or operate trucks, and we do not transport freight. Carriers who work with us operate under their own FMCSA operating authority at all times.
We are not a freight broker. We act only as the agent of the carriers we dispatch, under a written dispatch agreement with each one. We work only with freight brokers, never directly with shippers. Every load is booked under the carrier's own operating authority, and the carrier approves every load. We never receive, hold or handle payment for any load. Brokers pay the carrier, or the carrier's factoring company, directly.
Eligibility
To use our dispatch services, you must hold active FMCSA operating authority and an active USDOT number. You must also carry at least $1,000,000 auto liability and $100,000 cargo coverage, or higher amounts if the law or a broker requires them. You are responsible for keeping your authority and insurance current.
Our services
We provide load sourcing, rate negotiation with freight brokers, route planning and paperwork. We also follow up on detention, layover and TONU pay owed by brokers, and give related dispatch support. The details are on this site and in your dispatch agreement.
No guarantee of loads or income
We do not guarantee any number of loads, any rate or any income. Freight availability depends on market conditions outside our control. Rates shown on this site are market averages, not promises. Nothing on this site or in our communications should be read as a promise of specific earnings.
Your responsibilities
You are responsible for operating your vehicle safely and following all laws and regulations that apply. You must also keep your own authority and insurance active, and give us accurate information about your equipment and qualifications. You decide whether to accept each load.
Fees and payment
Our fee is a flat percentage of your weekly gross: 6% for dry van, reefer, flatbed and power only, and 8% for box truck and hotshot. Weekly gross is what brokers pay on loads delivered Monday to Sunday. It includes linehaul, fuel surcharge, detention, layover and TONU, but not lumper fees or other money you're only reimbursed for.
Free trial: we charge no dispatch fee on any load picked up during your first 3 days of dispatch with us. The fees above apply to loads picked up after that.
Every Monday we send one invoice for the prior week's loads. The fee for each load is due within 3 business days after the later of the invoice date or the date you receive payment for that load. You can pay by ACH, Zelle or a secure payment link. If a broker never pays you, you owe us nothing for that load.
Tell us about any invoice error within 7 days. There's no late fee, but fees more than 15 days late may pause dispatching until they're paid.
Termination
Either party may end the dispatch relationship by giving one week's notice by text or email. You may stop us from booking new loads at any time, effective immediately. Loads already booked still get delivered, and their fees are still due.
Your dispatch agreement
When you become a dispatch customer, you sign a separate dispatch agreement that covers your fee, payment, termination and each side's responsibilities on your loads. These terms cover your use of this website and our services in general.
If these terms conflict with your signed dispatch agreement, the dispatch agreement controls for the dispatch services it covers. These terms control your use of this website and anything the dispatch agreement does not address.
Third parties
Freight brokers, shippers, factoring companies and payment processors are independent businesses. We don't control them and aren't responsible for their actions, including a broker's failure to pay. We check brokers before booking, as described on our How We Vet Brokers page, but no check guarantees payment.
Use of this website
You may use this site to learn about our services, read our guides and contact us. Don't misuse it. For example, don't try to disrupt it or collect information from it automatically. Don't submit false information through the contact form or in your carrier documents.
The content on this site is general information, not legal, tax or financial advice. Check rules that affect your business with FMCSA, your state or a qualified professional.
Limitation of liability
To the fullest extent the law allows, two limits apply. First, neither party is liable to the other for lost profits, lost revenue or lost loads. Neither is liable for any indirect, incidental, special, consequential or punitive damages, even if told they were possible.
Second, our total liability for all claims about this website or our services is capped. The cap is the greater of $100 or the dispatch fees you paid us in the 30 days before the event that led to the claim.
You are responsible for claims arising from your trucks, drivers, freight, accidents, cargo loss or damage, and your compliance with law. We are responsible for claims arising from our own dispatching errors, subject to the limits above.
These limits do not apply to gross negligence, willful misconduct, fraud, or fees you owe us, or where the law does not permit them. If you have a signed dispatch agreement, its liability terms apply to your loads.
Dispute resolution
Before filing any claim, each party will first try in good faith to resolve the dispute by email or phone for 15 days. If it is not resolved, any lawsuit must be brought only in the state or federal courts located in Nassau County, New York. Both parties consent to those courts' jurisdiction. Either party may instead bring a claim in small claims court if it qualifies. Each party waives its right to a jury trial.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
Changes to these terms
We may update these terms from time to time. We will post the updated date at the top. For material changes, we will email active customers at least 15 days before they take effect. Continuing to use our services after changes take effect means you accept the updated terms.
